TestDino Terms and Conditions

The following terms and conditions govern all use of the www.testdino.com website ("TestDino") and all content, services, and products available at or through the website. We offer our Services on the condition that you accept these terms in full, along with any other rules and policies we publish, including TestDino's Privacy Policy (together, the "Agreement"). You agree that we may upgrade our Services automatically, and these terms apply to any upgrade.
Please read this Agreement carefully before accessing or using our Services. You accept this Agreement by ticking the acceptance box when you create a TestDino account, and again by accessing or using any part of our Services. If you do not agree to all of it, you may not access or use our Services. If these terms count as an offer by TestDino, your acceptance is limited to these terms.
TestDino is a workplace tool and is not directed to children. You must be at least 18 years old to create an account if you are in India, and at least 13 years old (or the age of digital consent in your jurisdiction) elsewhere. Any person who registers as a user or provides personal information to our Services represents that they meet the age that applies to them.
Use of our Services requires a TestDino account. You agree to provide us with complete and accurate information when you register for an account, and to keep it accurate, as set out under Identity and Registration below. You will be solely responsible and liable for any activity that occurs under your username. You are responsible for keeping your password secure.
Definitions
Capitalised terms have the meanings below wherever they appear in this Agreement.
- "Platform" means the Services, including the web application at app.testdino.com, the application programming interfaces and MCP interface TestDino publishes, and the hosted infrastructure behind them. It does not include open-source components, which are addressed under Open Source and Interoperability.
- "Customer" means the person or organisation that holds a TestDino account. Where this Agreement says "you", it means the Customer.
- "Authorized User" means an individual who accesses the Platform under the Customer's account, or on the Customer's behalf, or for the Customer's benefit.
- "Permitted Purpose" means use of the Platform by an Authorized User, on behalf of the Customer, for the internal purpose of recording, analysing, and acting upon that Customer's own automated test results.
- "Non-Public Environment" means any part of the Platform that TestDino has not made generally available, including staging, preview, sandbox, pre-release, internal, and feature-flagged environments, together with any endpoint, host, build, dataset, or interface reachable only by credential, invitation, undocumented address, or configuration not published by TestDino.
- "Interface Materials" means the visual design, layout, navigation structure, information architecture, screen flows, iconography, illustrations, written interface text, onboarding sequences, error and empty states, product documentation, and support content of the Platform, in each case as expressed by TestDino, and excluding any idea, method, or function they express.
- "Restricted Party" means any person or entity that, directly or through an affiliate, develops, markets, resells, or operates a product or service that performs substantially the same function as the Platform, and any person acting for, employed by, engaged by, or materially funded by such a person or entity. A person does not become a Restricted Party merely by using a general-purpose development, hosting, or continuous-integration tool.
TestDino
External links and intellectual property
If you create an account on TestDino, you are responsible for maintaining the security of your account and are fully responsible for all activities that occur under that account. You must immediately notify TestDino of any unauthorized uses of your account or any other breaches of security. TestDino will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.
TestDino may:
- Reclaim an organization or workspace identifier due to prolonged inactivity.
- Refuse or remove any content that, in TestDino's reasonable opinion, violates any TestDino policy or is in any way harmful or objectionable.
- Terminate or deny access to and use of TestDino to any individual or entity for any reason.
TestDino will have no obligation to refund any amounts previously paid.
TestDino Services Description
TestDino is a test intelligence and observability platform for Playwright teams. The Service includes a web dashboard at app.testdino.comand the @testdino/playwright package for streaming Playwright test results in real time. Features include test reporting, flaky test detection, error grouping, embedded trace viewing, AI failure analysis, CI/CD integrations, and analytics across runs.
Scope of Permitted Use
You may access and use the Platform solely for the Permitted Purpose. Any access or use for another purpose is outside the licence granted under this Agreement and constitutes unauthorized access, whether or not it was accomplished using valid credentials.
You shall not access or use the Platform in order to design, specify, build, price, position, or market a product or service that performs substantially the same function as the Platform, nor to compile a comparison, evaluation, benchmark, or competitive assessment of the Platform, except with TestDino's prior written consent. TestDino will not unreasonably withhold consent for the purpose of good-faith, factually accurate comparison by a party that identifies itself before requesting access. Eligibility
Eligibility to access the Platform is a continuing condition of the licence granted under this Agreement. A Restricted Party is not eligible to access or use the Platform, whether directly, through an Authorized User, through a third party, or through any account held by another Customer, except under a written agreement signed by TestDino.
Where a Customer or Authorized User becomes a Restricted Party during the term, eligibility lapses automatically and access must cease. You shall notify TestDino in writing within five (5) business days of becoming aware of the change.
Access obtained or continued while ineligible is unauthorized access for the purposes of the Scope of Permitted Use, and the licence is treated as never having extended to it.
Identity and Registration
- Registration information must be accurate and complete when given and must be kept accurate, including the identity of the Customer, the identity and employer of each Authorized User, and any affiliation with a Restricted Party.
- No person may register or maintain an account using a false or borrowed identity, an undisclosed intermediary, a disposable or forwarding email address used to obscure affiliation, or any other arrangement whose effect is to conceal who is accessing the Platform or on whose behalf.
- No person may create or maintain multiple accounts to obtain usage entitlements beyond those attaching to a single account, or to regain access after an account has been suspended or terminated.
- Where access is obtained through a material misstatement or concealment under this section, TestDino may treat the access as unauthorized from the outset, and you indemnify TestDino against the reasonable costs of investigating and remediating it.
Responsibility for Authorized Users
You are responsible for the acts and omissions of your Authorized Users, and of your employees, contractors, agents, and any person accessing the Platform through your account or credentials, as if they were your own acts and omissions.
Where a person accesses the Platform on your behalf, for your benefit, or in the course of work performed for you, that access is access by you for the purposes of this Agreement, whether or not the account was registered in your name or using your domain.
General Terms
Automatic Renewal
Unless you notify TestDino before the end of the applicable subscription period that you want to cancel an Upgrade, your subscription will automatically renew and you authorize us to collect the then-applicable subscription fee (as well as any taxes) using any payment mechanism we have on record for you. Upgrades can be canceled at any time in the Upgrades section of your account settings.
Refund Policy
If the product isn't right for you, we refund your money within five (5) business days. Full details follow.
1. 14-Day Money-Back Guarantee
- Eligibility: Request a full refund within 14 days of your initial purchase if you are not satisfied.
- How to Request: Email support within 14 days, providing your account details and the reason for the refund. Refund requests are reviewed and processed by TestDino support or administrators and are not issued automatically through self-serve cancellation.
- Processing Time: Refunds are processed within five (5) business days after receipt of your request.
2. Free Trial Period and Auto-Renewal
- Eligible first-time users receive a 14-day free trial. Repeat subscriptions or returning users may not receive an additional trial.
- At the end of the free trial, your account is charged according to the selected plan.
3. Recurring Payments
- Subscriptions renew automatically unless canceled before the end of the current term.
4. Cancellation
- Canceling during the free trial ends the trial immediately and prevents any billing.
- Canceling a paid subscription stops future renewal and keeps access active until the end of the current billing period.
How to Cancel
- Log in to your TestDino account.
- Go to Account Settings → Manage Subscription.
- Select Cancel Subscription and confirm.
- A confirmation email is sent immediately upon successful cancellation.
Responsibility of Visitors
TestDino has not reviewed, and cannot review, all user-generated content (including software) posted to our Services and therefore cannot be responsible for that material's content, use, or effects. By operating our Services, TestDino does not represent or imply that it endorses the material posted, or that it believes such material to be accurate, useful, or non-harmful. You are responsible for taking precautions to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content.
Our Services may contain user-generated content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. Our Services may also contain material that violates the privacy or publicity rights or infringes the intellectual-property and other proprietary rights of third parties. TestDino disclaims any responsibility for any harm resulting from the use by visitors of our Services or from any downloading by those visitors of content posted there.
Acceptable Use Policies
Prohibited activities include (but are not limited to) illegal content, promotion of cryptocurrency or social-media-manipulation services, infringements of intellectual property, harassment, malware distribution, denial-of-service attacks, and any activity that degrades or harms the Platform or its users. Breach results in immediate account termination.
In addition, no person may:
- Systematically extract. Extract, harvest, index, or accumulate data, records, metrics, configuration, feature descriptions, or interface content from the Platform, whether manually, by automated means, or by directing a third party or automated agent to do so. This does not restrict exporting your own data through functionality TestDino provides for that purpose.
- Reverse engineer or modify. Modify, adapt, translate, or create a derivative work of any part of the Platform, or reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, underlying structure, or implementation, except to the extent such restriction is prohibited by applicable law, and then only after written notice to TestDino.
- Resell or pass on access. The licence is granted to you for your own use. No person may resell, sublicense, rent, lease, distribute, or make the Platform available to any third party, or use it to provide a service to any third party, except under a written agreement signed by TestDino.
- Remove notices. Remove, obscure, or alter any proprietary, attribution, copyright, or trade mark notice appearing on or within the Platform, or in any output, export, or report it generates.
- Use unlawfully or introduce harmful code. Use the Platform in violation of applicable law or in a manner that infringes the rights of any person; upload, transmit, or introduce any code, file, or instruction intended to damage, disable, intercept, exfiltrate, or impair any system, data, or service; or take any action that materially impairs, overburdens, or threatens the security, integrity, availability, or performance of the Platform or of any other Customer's use of it.
- Monitor the Platform. Monitor the availability, response time, error rate, throughput, or other operational characteristics of the Platform, or publish the results of such monitoring, except in respect of your own usage or with TestDino's prior written consent.
Non-Public Environments and Technical Boundaries
- Non-Public Environments are provided, where provided at all, only to persons expressly invited by TestDino in writing, and only for the purpose stated in that invitation. Access to a Non-Public Environment is never implied by access to the generally available Platform.
- No person may access, attempt to access, or continue in a Non-Public Environment without a current written invitation, including where access is technically possible because of an unpublished address, a permissive configuration, a shared or expired credential, a stale invitation, or a defect. Technical accessibility does not confer permission.
- No person may probe, scan, enumerate, fuzz, or conduct vulnerability, penetration, or load testing against any part of the Platform without TestDino's prior written authorisation. Nothing in this clause restricts good-faith security research conducted in accordance with TestDino's published security reporting process, and TestDino will not pursue a researcher who complies with it.
- No person may share, publish, resell, or transfer credentials, API keys, tokens, or invitation links, or use credentials issued to another person.
- No person may access the Platform by automated means, including crawlers, scrapers, headless browsers, autonomous agents, and model-driven clients, other than through interfaces TestDino publishes for that purpose and in accordance with their documented limits. TestDino publishes an API and an MCP interface for programmatic access; use those.
Content Posted on Other Websites
We have not reviewed, and cannot review, all material (including software) made available through websites and webpages to which TestDino links, and that link to TestDino. TestDino does not have any control over those non-TestDino websites and is not responsible for their contents or use. By linking to a non-TestDino website, TestDino does not represent or imply that it endorses such website. You are responsible for taking precautions to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. TestDino disclaims any responsibility for any harm resulting from your use of non-TestDino websites and webpages.
Intellectual Property
This Agreement does not transfer from TestDino to you any TestDino or third-party intellectual property. Every right, title, and interest in that property stays solely with TestDino. TestDino, www.testdino.com, the TestDino logo, and all other trademarks, service marks, graphics, and logos used in connection with TestDino or our Services are trademarks or registered trademarks of TestDino or TestDino's licensors. Other trademarks, service marks, graphics, and logos used in connection with our Services may be those of other third parties. Your use of our Services grants you no right or license to reproduce or otherwise use any TestDino or third-party trademarks.
Interface Materials
Interface Materials are the original expression of TestDino and are protected by copyright and other applicable rights. Nothing in this Agreement transfers any interest in them.
No person may reproduce, adapt, translate, or produce a derivative of Interface Materials, in whole or in substantial part, in any medium, including by transcription, screen capture, machine extraction, or model-assisted reproduction.
The preceding paragraph is directed at TestDino's expression. It does not restrict the independent implementation of any idea, method, function, protocol, or interoperability requirement that Interface Materials express, and does not restrict factual description of the Platform.
No adverse intellectual property assertions
As a condition of access, you undertake not to assert, and not to fund or assist a third party in asserting, any claim of intellectual property infringement against TestDino in respect of the Platform or its Interface Materials.
Open-Source Components and Interoperability
- Relationship to open-source components. Certain TestDino components are published under open-source licences identified in the repository or distribution containing them. Those licences govern use of that source code and are not varied, narrowed, or supplemented by this Agreement. This Agreement governs access to and use of the hosted Platform, which is licensed separately and is not made available under any open-source licence.
- Substitute implementations. No person may use access to the Platform to specify, design, test, or validate a service that receives, stores, or serves test execution data in substitution for the Platform, including by deriving, inferring, or documenting the Platform's application programming interfaces, wire protocols, payload structures, authentication flows, or data schemas from observation of the Platform in operation.
- Integrity of notices in redistribution. Where a TestDino component is redistributed under an open-source licence, all copyright, attribution, licence, and provenance notices must be preserved intact in source and in any accompanying documentation, and any modification must be marked as such. Redistribution that removes or obscures such notices falls outside the licence granted.
- Trade marks are excluded from every licence. No licence granted by TestDino, whether under this Agreement or under any open-source licence applying to a TestDino component, conveys any right to use the TestDino name, the TestDino logo, or any confusingly similar name or mark, whether in a product name, package name, domain, repository, service description, or promotional material, or in any manner suggesting affiliation, sponsorship, or endorsement by TestDino.
- Contributions. Contributions submitted to a TestDino repository are accepted only under the contributor licence agreement published with that repository. A person who has submitted a contribution obtains no right in the Platform, and no right to use, disclose, or build upon information learned in the course of contributing beyond the terms of that agreement.
- Interoperability. Nothing in this section restricts the independent creation of software that interoperates with the Platform through interfaces TestDino publishes for that purpose, nor the exercise of any right that applicable law confers regardless of contract.
Copyright Infringement
As TestDino asks others to respect its intellectual-property rights, it respects the intellectual-property rights of others. If you believe material located on or linked to by TestDino violates your copyright, send a notice to our designated agent identifying the work, the material you say infringes it and where it is, your contact details, a statement of good-faith belief that the use is not authorised, and a statement under penalty of perjury that the notice is accurate and you are authorised to act.

TestDino responds to every valid notice, including by removing the material or disabling links to it, in line with the Digital Millennium Copyright Act for United States claims and with the due-diligence obligations of section 79 of India's Information Technology Act, 2000. The user who posted the material may send a counter-notice, and we may restore the material if the complainant does not seek a court order within the period the applicable law allows. TestDino terminates the access of repeat infringers, without any obligation to refund amounts previously paid.
Disclaimer of Warranties
Our Services are provided "as is." TestDino, its suppliers, and its licensors disclaim all warranties of any kind, express or implied, including, without limitation, any implied warranty of merchantability, of fitness for any particular purpose, or of non-infringement. TestDino, its suppliers, and its licensors do not warrant that our Services will be error-free or that access will be continuous or uninterrupted. TestDino will use commercially reasonable efforts to keep the Services secure, virus-free, uninterrupted, and error-free, but does not warrant that result.
Limitation of Liability
In no event will TestDino or its suppliers or licensors be liable for:
- Any special, incidental, or consequential damages;
- The cost of procurement for substitute products or services;
- Amounts that exceed the fees paid by you to TestDino under this Agreement during the twelve-month period prior to the cause of action.
TestDino shall have no liability for any failure or delay due to matters beyond its reasonable control. None of the above applies where prohibited by applicable law.
General Representation and Warranty
You represent and warrant that (i) your use of our Services will be in strict accordance with the TestDino Privacy Policy, with this Agreement, and with all applicable laws and regulations (including local laws regarding online conduct and acceptable content, and laws regarding the transmission of technical data exported from the country in which you reside) and (ii) your use of our Services will not infringe or misappropriate the intellectual-property rights of any third party.
Indemnification
You agree to indemnify and hold harmless TestDino, its contractors, and its licensors, and their respective directors, officers, employees, and agents against losses, damages, liabilities, and reasonable legal costs, including attorneys' fees, arising from your breach of this Agreement, including the sections on Permitted Use, Eligibility, Identity and Registration, Non-Public Environments, Acceptable Use, Intellectual Property, and Open-Source Components, or from any claim brought by a third party in connection with your use of our Services.
TestDino will notify you promptly of any such claim and will not settle it without your consent, not to be unreasonably withheld.
Suspension and Termination
TestDino may terminate your access to all or any part of our Services at any time, with or without cause or notice, effective immediately. TestDino may suspend or terminate access immediately, without notice and without refund, where it reasonably believes the sections on Permitted Use, Eligibility, Identity and Registration, Non-Public Environments, Acceptable Use, or Intellectual Property have been breached. If you wish to terminate this Agreement or your www.testdino.com account (if you have one), stop using our Services.
You acknowledge that breach of the sections on Eligibility, Non-Public Environments, or Intellectual Property may cause harm not adequately compensable in damages, and TestDino may seek injunctive relief without being required to prove actual damage or provide security, in addition to any other remedy.
If you breach the section on Identity and Registration, you shall reimburse TestDino's reasonable and documented costs of investigating and remediating the breach. This is an indemnity for actual, evidenced expenditure and is not a stipulated penalty.
Any part of this Agreement that should outlast termination stays in effect, however termination arises, including the sections on Eligibility, Identity and Registration, Non-Public Environments, Intellectual Property, Open-Source Components, and this section, together with ownership terms, warranty disclaimers, indemnities, and limitations of liability.
Account Deletion After Inactivity
If a Client's plan is canceled and the account remains inactive for 60 days, TestDino may permanently delete the account and all related data. A notice will be sent before deletion; logging in or contacting support prevents deletion.
Changes to These Terms
We update our Services over time, and that sometimes means changing these terms. The date at the top of this page shows when they last changed.
If a change is material, it takes effect for existing Customers thirty (30) days after we give notice by email to the account's registered address and by a persistent notice in the Platform. If you disagree, stop using our Services and close your account within that period. Continued use after the effective date means you accept the new terms. Any dispute that arose before a change is governed by the terms in place when it arose. New terms never apply to conduct that occurred before their effective date.
Terms and Conditions – Developer & Client
1. General Terms
The user (the "Client" or "User") and Alphabin Technology Consulting (the "Developer") agree to the following terms. You accept these terms when you sign up for a TestDino account or visit any website the Developer owns.
2. Intellectual Property Rights
- The Developer possesses the rights, licenses, and authorizations necessary for the development and implementation of the Platform. The intellectual property of all development remains exclusively with the Developer.
- The Developer grants the Client a paid license to use the Platform and any modifications. The license is non-transferable, non-sub-licensable, non-exclusive, time-limited, and limited to the agreed territory.
- All text, graphics, UI elements, photographs, brands, logos, sounds, music, illustrations, content, and programming code (source or object) are the exclusive property of the Developer or its licensors and are protected by intellectual-property laws.
3. Confidentiality
- "Confidential Information" includes all non-public information identified as confidential or that reasonably should be treated as confidential.
- Exceptions include information that is public, previously known, independently developed, or lawfully obtained without restriction.
- The Client must not disclose Confidential Information without prior written consent.
- Confidentiality obligations survive indefinitely.
- The Developer may use the Client's implementation for lawful marketing purposes, such as case studies, provided the Client's image and prestige are not harmed.
4. General Conditions
- If any part of these Terms is illegal, null, or unenforceable, the remaining terms remain in effect.
- Waiver of any breach does not imply waiver of future breaches.
- These Terms may be modified at any time by mutual written agreement.
Terms of Service – Client
1. Subscription & Payments
- The Client pays in advance at the start of each period. Failure to pay within 30 days may result in blocked access and a 1% daily penalty on overdue amounts.
- The Client may cancel at any time; prepaid amounts are non-refundable.
2. Guarantees & Service Levels
- The Developer guarantees platform functionality when used per these Terms.
- Monthly availability rate: 97%.
- Availability exclusions include factors beyond the Developer's control (e.g., internet outages, third-party hardware/software, Client actions, beta versions).
- Client must submit detailed claims for downtime.
- If availability drops below 97%, the Client receives up to 25% credit on the next invoice.
- The Developer provides technical assistance, bug fixes, and training materials as needed.
Terms of Use – User
All references to the Provider or Operator point to Alphabin Technology Consulting and TestDino as applicable. Key provisions include:
- Minimum age 13 years.
- Definitions of User, Registered User, Administrative User, User Information, Protected Content, and Protected Brands.
- Limited license to access and use the Platform; no resale or reverse engineering.
- User responsibilities: provide truthful information, respect intellectual-property rights, comply with Acceptable Use Policies.
- Operator responsibilities: manage Platform access, maintain credential confidentiality, comply with data-protection laws.
- Warranty & liability limitations; the Provider is not liable for user-generated content or indirect damages.
- Termination procedures for rescission or breach.
- Miscellaneous provisions on assignment, modifications, governing law (India), and severability.
Jurisdiction
This Agreement is governed by the laws of India, and falls under the exclusive jurisdiction of the courts of Gujarat, India.
Nothing in this Agreement limits any right you hold as a consumer under the mandatory law of the country or state where you live, including the right to bring a claim before the courts of that place where that law grants it.
Notwithstanding the governing law and jurisdiction provisions of this Agreement, TestDino may apply for injunctive or other equitable relief, and may pursue remedies for infringement of its intellectual property rights or for breach of the sections on Eligibility, Non-Public Environments, Intellectual Property, Acceptable Use, or Open-Source Components, before the courts of any jurisdiction in which the relevant conduct occurs or has effect.
Privacy Policy
The Privacy Policy referenced throughout these Terms is incorporated by reference and constitutes an attachment to this document.
For Customer Content, Alphabin Technology Consulting processes personal data on your documented instructions as a Data Processor under India's Digital Personal Data Protection Act, 2023 and under Article 28 of the GDPR, on the terms of our Data Processing Agreement. You remain the Data Fiduciary or controller for that data.
